By accessing or using Food Designer ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Food Designer is a digital menu creation and management platform that allows restaurant owners to create, customize, and share digital menus with their customers. The Service includes menu creation tools, design customization, QR code generation, and menu sharing capabilities.

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Upload or transmit harmful code, viruses, or malicious software
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Collect or store personal data about other users without permission

5. Content and Intellectual Property

You retain ownership of all content you create using the Service, including menus, images, and text. By using the Service, you grant us a limited, non-exclusive license to store, process, and display your content as necessary to provide the Service.

The Service itself, including its design, features, and functionality, is owned by Food Designer and protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service.

6. Subscription and Payment

Certain features of the Service may require a paid subscription. By purchasing a subscription, you agree to:

• Pay all applicable fees as described at the time of purchase
• Automatic renewal of subscriptions unless cancelled
• No refunds for partial subscription periods

Subscription fees are processed through your device's app store (Apple App Store) and are subject to their terms and conditions.

7. Service Availability

We strive to provide reliable service but do not guarantee that the Service will be available at all times. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from Service unavailability.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

9. Termination

You may terminate your account at any time through the Account Management section in your profile. We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or harmful activities.

Upon termination, your access to the Service will cease, and we may delete your account and associated data in accordance with our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, Food Designer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless Food Designer, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the app and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Malaysia.
